Terms of Service

These Terms govern your use of Oort (the "App"), provided by Octet Software ("we", "us", or "our"). By downloading or using Oort, you agree to these Terms and to the Apple-required terms referenced below.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Oort on Apple devices you own or control, in accordance with the Apple Media Services Terms and these Terms.

2. Purchases & unlocks

Oort may offer a paid purchase or one-time unlock through the Apple App Store. All payments are handled by Apple. Refunds are governed by Apple's policies and may be requested through Apple. Restoring a previous purchase is available within the App.

3. Your music and accounts

Oort plays music you already own or have the right to access through your own cloud-storage accounts. You are solely responsible for your content and for complying with the terms of any third-party service (such as Dropbox or OneDrive) you connect.

4. Acceptable use

You agree not to misuse the App, attempt to reverse engineer it except as permitted by law, or use it to infringe anyone's rights.

5. Disclaimers

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be uninterrupted or compatible with every cloud provider, file format, or device, and third-party services may change in ways outside our control.

6. Limitation of liability

To the maximum extent permitted by law, Octet Software will not be liable for any indirect, incidental, or consequential damages, or for any loss of data. Our total liability will not exceed the amount you paid for the App.

7. Apple as third-party beneficiary

These Terms are between you and Octet Software, not Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Any maintenance, support, or warranty claims are our responsibility, not Apple's.

8. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

9. Changes

We may update these Terms; the "Last updated" date reflects the latest version. Continued use after changes constitutes acceptance.
